How much can you claim as TUI flight compensation?

The length of your journey and the duration of your TUI flight delay determine the amount of compensation you are owed for your flight delay claim.

When can you claim flight compensation from TUI Airways?

According to your passenger rights, passengers are entitled to compensation in the following circumstances:

  • If your TUI flight arrived at your final destination more than 3 hours late, you can claim compensation for a delayed flight.
  • If your TUI flight was cancelled and you were informed of the disruption less than 14 days before the scheduled flight date.
  • You were involuntarily denied boarding to a TUI flight service (e.g. due to overbooking).

TUI Delayed Flight Compensation

In order to claim delay compensation from TUI, your flight needs to meet three important conditions:

  • Your flight departed from an EU airport or you flew with an EU-registered airline
  • You arrived at your final destination at least 3 hours late
  • Your TUI flight delay was not due to any extraordinary circumstances

Check Compensation

Extraordinary circumstances are any conditions that prevent a flight from arriving on time and that cannot be prevented or ameliorated by TUI. Airlines are not required to compensate their passengers in these cases as the mitigation of the delay is outside their capabilities and duties.

The most common instances of extraordinary circumstances include:

  • Bad weather (snowstorms, low visibility, sandstorms, among others).
  • Natural disasters
  • Security risks
  • Bird Strikes
  • Air Traffic Control or airport personnel strikes
  • Runway closures and/or other Air Traffic Control restrictions

Technical issues, lightning strikes and wildcat strikes are not interpreted as cases of extraordinary circumstances. Mechanical defects and lightning strikes are considered part of an aircraft’s normal operations. Therefore, by definition, there is nothing extraordinary about them and passengers can claim delay compensation from airlines such as TUI Airways.

Wildcat strikes encompass all cases of industrial action in which the airline personnel spontaneously strikes against a carrier’s restructuring. Since the strike was caused by the management’s decisions, airlines cannot claim that the delay or cancellation was due to any exceptional circumstances.

In addition, passengers would be eligible for compensation only if the duration of their TUI flight delay exceeded 3 hours. It is important to note that this refers to the time of arrival at the final destination, not the time of departure. In other words, there may be a few cases in which passengers await their departure for more than 3 hours but are not entitled to compensation. These would occur when the TUI crew succeeds in reducing the final arrival delay.

We encourage you to note down your time of arrival when you reach your final destination. This will help you submit your claim for TUI flight delay compensation later on.

TUI Compensation for Cancelled Flights

The most important thing about flight cancellations is that regardless of whether you can claim compensation, you remain entitled to a replacement flight or a full ticket refund.

In addition, if your flight was cancelled, you may be entitled to TUI cancellation compensation. The most important condition for claiming a refund is that you were notified of the cancellation less than 14 days before the original flight date.

Imagine you were informed of the disruption between 7 and 14 days prior to your flight. You can claim TUI flight compensation if your alternate flight arrives with a delay of over 4 hours.

If you were notified of the cancellation less than a week before departure, you can claim compensation after the second hour of delay.

Notice Given Arrival at Final Destination
14 Days or More No compensation
7-13 Days Your alternate flight arrived at your final destination more than 4 hours late.
Less than 7 Days

Your replacement flight arrived at your final destination more than 2 hours late.

Right to Care

It is important to remember that the airline is obliged to assist you in the event of delayed or cancelled flight. Passengers can have their food and drinks expenses covered by the airline for the duration of the delay or until the departure of their alternate flight.

If your flight is cancelled and your alternate flight is scheduled for the next day, the airline is required to cover all of your hotel accommodation and transport costs.

Remember that the above mentioned right is completely separate from the right to compensation for a delayed flight regardless of the circumstances.

It is important to note, that you, as a passenger should hold on to your receipts, as they are required from the airline.

Is my flight eligible?

Denied boarding

As with flight delays and cancellations, if you are involuntarily denied boarding, you can claim compensation. The amount of the compensation will depend on the distance of your flight:

  1. Flights shorter than 1500km - €250
  2. Flights between 1500km and 3500km - €400
  3. Flights above 3500km - €600

Additionally TUI airways would be required to provide you with a full refund for the cost of your ticket or an alternate flight to your flight destination.
