Air passenger rights for LOT flight delays

Europe and UK

The following flights fall under the EU261 and UK261: flights with airlines registered in the EU or UK and flights departing from EU or UK airports. A delayed flight with LOT Polish Airlines could bring compensation between $265 (€250) and $700 (€600) depending on the distance covered by the flight.

The conditions for compensation eligibility are simple: the plane should arrive at its final destination a minimum of 3 hours later than the officially announced landing time and the flight delay should not be the result of extraordinary circumstances. Examples of such would be bad weather conditions, bird strikes, terrorist attacks, etc.

USA

Unfortunately, that means that the regulation excludes most flights with US-registered air carriers; however, passengers on codeshare flights operated by an EU airline may still have the right to compensation. Thus, LOT Polish Airlines flights departing from European airports and booked via codeshare reservations through a US airline would be eligible for EU261 compensation.

What to do in case of a LOT flight delay

The reimbursement that LOT needs to pay to its customers in case of flight delays depends on the length of the journey in kilometers and the duration of the delay. The table below gives a detailed overview of the different scenarios and the possible compensation amounts.

LOT Polish Airlines canceled flight compensation

When a LOT flight gets canceled, you are entitled to claim flight cancellation compensation from the airline. Naturally, there should be no extraordinary circumstances present, since that would automatically waive your right for reimbursement.

If LOT cancels a flight for reasons within their scope of control (like technical issues with the aircraft or internal staff problems/strikes), the Polish air carrier will be obliged to provide a replacement flight at the earliest convenience or a full refund for the ticket fare paid by you. In addition, per EU261, LOT may need to pay between $275 and $700 as flight cancellation compensation, depending on the time you were notified about the cancellation.

You will be entitled to receive reimbursement if:

You were notified less than 14 days before take-off
If your alternate flight arrived at your final destination more than 4 hours behind schedule (when notice is given more than 7 days before the flight) or more than 2h late (when notice is given less than 7 days before).

Missed connection and denied boarding

EU261 does not only protect air passenger rights for delayed or canceled LOT flights. You may also be eligible for compensation of up to $700 ( €600) if either of the two apply to your flight:

You missed a connection because of a LOT delay or cancellation
Your LOT flight was overbooked, and you were denied boarding .

In case of a missed connection, you will only be entitled to compensation if all of your flights are booked under the same reservation number. It doesn’t matter if they are with different airlines (the Polish air carrier operates many codeshare flights) as long as the booking is the same. Thus, you will be eligible for compensation for the whole journey and not for just one leg.

In case of denied boarding, you will have the right to financial compensation under EU261 if you do not accept any other offers from the airline, like travel vouchers, upgrades, etc.
