Even if Emirates is not a European airline and if EU261 only applies to flights departing from European airports, US citizens could also have their rights protected by this regulation. In the EU

Regulation EC261/2004 (EU261) applies to all air passengers, no matter their nationality, as long as their delayed flight with Emirates departs from Europe. Additionally, the delay should not be the result of extraordinary circumstances. Examples of such would be bad weather conditions, bird strikes, closure of airports due to staff strikes, restrictions applied by air traffic control, and security risks.

According to EC261 a flight is considered delayed if it reaches its final destination more than 3 hours later than the officially announced landing time. It is important to make this distinction, as planes sometimes take off more than 3 hours later than originally planned but can “catch up” during the flight and to minimize the delay.

Compensation amounts for Emirates flight delay compensation

Depending on the distance covered by the delayed flight, Emirates will have to pay you between $275 (€250) and $700 (€600). Shorter flights are only eligible for the smallest compensation amount, regardless of the duration of the delay. A delayed long-haul flight, however, could bring you the maximum compensation if it arrives at its final destination with over 4 hours delay.
