How to get compensation for your UIA flight delay?

Fortunately airlines are EU regulated to pay compensation for flight disruptions. According to European Regulation 261 / 2004, if you have experienced a delayed flight, cancellation or denied boarding on a UIA flight, you could be entitled to compensation of up to €600.

What is the compensation amount that am I eligible to?
Compensation eligibility depends on the distance of your disrupted UIA flight.
For flights shorter than 1500km, you could claim €250. If your flight distance was between 1500 and 3500km, you have the right to claim €400. Journeys which exceeded 3500km are eligible to a compensation of up to €600.

There are two important exceptions.
- If your flight began and ended from airports within countries in the European Union, the maximum amount that you could claim is €400, even when the trip’s distance exceeds 3500km.
- If your journey exceeded 3500km and your delay at the final destination was between 3 and 4 hours, the airline has the right to reduce your compensation by half.
Do I have the right to be compensated for my UIA disrupted flight?
As Ukraine International Airlines is not in the European Union, Regulation (EC) 261/2004 applies to air passengers which are departing from an EU airport.
Ukraine International Airlines Flight Delay
If your flight meets the following conditions, you could be entitled to flight delay compensation:
- Your flight arrived at its final destination with a delay of more than three hours
- Extraordinary circumstances were not the main cause for the delay
The duration of a flight delay is the difference between the actual and the scheduled time of arrival. It is important to understand that the arrival time is the one that matters.
Extraordinary circumstances are also an important factor when you claim delay compensation as they are outside UIA’s ability to prevent. Common examples for extraordinary circumstances are:
- Bad weather conditions (snowstorms, heavy crosswinds, low visibility, hailstorms, etc.)
- Restrictions by Air Traffic Control (e.g runway closures or airport shutdowns)
- Bird strikes
- Airport personnel strikes
- Hidden manufacturing defects
The above mentioned examples are beyond the airline’s capabilities to prevent. In these instances Ukraine International Airlines would not be required to compensate you.
However, certain circumstances may appear extraordinary, but they are not. These include:

Technical problems with the aircraft
When connecting flights, missing your connection could lead to a significant overall delay. It is the airline’s responsibility to arrange a new flight. Furthermore if you are delayed by more than 3 hours at your final destination, you could be entitled to reimbursement.

UIA Cancelled Flight
If the airline cancelled your flight, you could be eligible to flight cancellation compensation. The following conditions should be met:

UIA did not cancel the flight due to any extraordinary circumstances.
- You were informed of the cancelled flight less than 14 days before the scheduled departure and your alternate flight arrived at the final destination more than 4 hours late
- You were informed 7 days or less before departure and the replacement flight arrived with a delay of 2 hours at the final destination

Passengers whose flights have been cancelled have the automatic right to a replacement flight to their final destination or a full refund of the ticket price. This right is retained even if passengers do not have the right to claim UIA cancelled flight compensation in the above mentioned cases.
UIA Denied Boarding
You are also protected when the airline denied boarding to the aircraft. It is important to know that you could be entitled to compensation only if you were involuntarily bumped from a flight and:

You presented yourself to the gate on time

You did not present any security or safety risk

You had all the necessary travel documents
The amount of your UIA denied boarding compensation is again determined by the distance of your flight. The only difference is that you are immediately entitled to a refund as you are not dependant on a delay at your final destination.
In addition to a reimbursement, the airline is required to provide you with one of the following:

A convenient alternate flight to your final destination

A full refund of your ticket

UIA is the flag carrier and the largest airline of Ukraine. It’s main hub is located at Kiev’s Boryspil International Airport. The airline was founded in 1992 and was the first airline in the former Soviet Union. In the years between 1996 and 2000, the company had different shareholders, some of them being Austrian Airlines, Swissair and the European Bank for Reconstruction and Development.
