Latam Airlines Flight Delay
You should meet two requirements in order to be eligible to claim compensation for a flight delay with Latam Airlines:
- You arrived at your final destination with a delay over three hours.
- The delay was not caused by any extraordinary circumstances.
Extraordinary circumstances could be some of the following:
- Bad weather conditions
- Bird strikes
- Security risks
- Control tower traffic restrictions
- Medical emergencies
Or any cause that is beyond the control of Latam Airlines.
Strikes are treated differently, though.. You can read more about your rights in case of flight delay due to airline staff strike in this article.
Latam Airlines Cancellation
If you were about to travel from Europe with Latam and your flight was cancelled, then you could be eligible for flight compensation.
According to EU Regulation 261/2004 (EC261) you have the right to claim compensation for a cancelled flight when Latam fails to notify you more than 14 days in advance:
-
Latam notifies you between 7 to 13 days before the flight - in this case, you can claim flight compensation if you reached your destination with over 4 hours of delay
- Latam informs you 7 or less days before departure and you reach the final destination with a total delay of over 2 hours.
The amount for the cancelled flight compensation is also calculated based on the travelled distance. The same amounts as for flight delays apply.
Notice Given | Arrival at Final Destination |
14 Days or More | No compensation |
7-13 Days | Your alternate flight arrived at your final destination more than 4 hours late. |
Less than 7 Days |
Your replacement flight arrived at your final destination more than 2 hours late. |
Denied Boarding
Have you been involuntarily bumped off a Latam Airlines flight? Sometimes air carriers sell more tickets exceeding the number of available seats on the airplane. The company starts searching for volunteers willing to give up their seats in exchange for benefits.
As boarding could be voluntarily or involuntarily denied, in order to be eligible to compensation you should be denied boarding against your will.
It is important that:
-
you presented yourself to the gate on time.
-
you did not present any security or safety risk.
-
you had all the necessary travel documents.
Again, the sum depends on the distance your flight covers.
